3.1 Refund Eligibility

Refunds are evaluated on a case-by-case basis in accordance with Spanish consumer protection law (Ley General para la Defensa de los Consumidores y Usuarios — Real Decreto Legislativo 1/2007). The following conditions apply:

• Services not yet initiated: full refund within 14 days of payment
• Services in progress: refund calculated proportionally to completed milestones
• Services completed: refund available only if deliverables substantially deviate from agreed specifications

3.2 Cancellation Terms

Clients may cancel ongoing projects with 14 days written notice. Payment for completed milestones up to the cancellation date is non-refundable. Any advance payments for uninitiated work will be returned within 30 business days.

3.3 Dispute Resolution

In the event of a dispute regarding refunds, KineticAxiom agrees to engage in good-faith mediation before any legal proceedings. Disputes shall be subject to the jurisdiction of the courts of Madrid, Spain.

3.4 Non-Refundable Items

Domain registration fees, third-party licensing costs, and hosting payments made on behalf of the client are non-refundable once processed.

4.1 Scope of Services

KineticAxiom provides digital design, development, and consulting services as described in individual project proposals. Each engagement is governed by a separate Statement of Work (SOW) that defines specific deliverables, timelines, and milestones.

4.2 Payment Terms

Unless otherwise specified in the SOW:

• 50% advance payment upon project initiation
• 50% upon delivery and acceptance of final deliverables
• Payment is due within 14 days of invoice date
• Late payments incur a 2% monthly interest rate in accordance with Spanish commercial law

4.3 Intellectual Property

Upon full payment, all intellectual property rights for custom-developed deliverables transfer to the client. KineticAxiom retains the right to display work in portfolio materials unless expressly prohibited in writing. Third-party components (libraries, frameworks, stock assets) remain subject to their original licensing terms.

4.4 Confidentiality

Both parties agree to maintain confidentiality regarding proprietary information shared during the engagement. This obligation survives the termination of the contract for a period of three (3) years.

4.5 Limitation of Liability

KineticAxiom's total liability under any engagement shall not exceed the total fees paid by the client for the specific project giving rise to the claim. KineticAxiom shall not be liable for indirect, incidental, or consequential damages.

4.6 Governing Law

These Terms of Service are governed by the laws of Spain. Any disputes shall be subject to the exclusive jurisdiction of the courts of Madrid, España.

4.7 Amendments

KineticAxiom reserves the right to amend these terms with 30 days written notice. Continued use of services after the amendment date constitutes acceptance of the modified terms.
